Cybersecurity Law has heavy impact the business community in China; particularly, cross-border data transfer requirements are likely to be thorny for companies. The Measures for Security Assessment of Data Exports came into force on 1st September 2022, to guide and assist data handlers in standardising and orderly reporting security assessments for data export.
What are the latest policies on cross-border data transfers, data authentication and data sharing? By analysing data export policies, foreign companies taking a global approach to cybersecurity and compliance can revise their regional cybersecurity policies and current cybersecurity practices.
The European Chamber’s Cybersecurity Conference 2023 will bring together professionals and experts from law/consulting firms, different industrial players, and major data processors to share their insights on the future of China’s data flow security landscape and possible solutions for all relevant parties.

Background:
Dakai leads KPMG’s Forensic Technology team in Shanghai and he has over 13 years of combined experiences in providing Cyber Incident Response, E-Discovery and Data Analysis services. He stared his career in KPMG Holland and relocated to Shanghai in year 2011.
Relevant Experience:
Dakai started his Forensic Technology career at KPMG The Netherlands and has been working with different teams across Europe ever since. He was on various international projects where he spent years working in UK, German, Belgium for projects serving different large multinational corporations.
In 2011, Dakai relocated to KPMG’s Shanghai office, where he continued to provide technology solutions to oversea companies as well as supporting engagements in regards to internal auditors, cyber security, risk and compliance, fraud prevention/detection, anti-corruption practices, FCPA and UK-Bribery compliance, due diligence, data acquisition and preservation, Anti Money Laundry, litigation support engagements.
Dakai lead various Digital investigation engagements in China to assist client and its external counsel exploring facts lay beneath different ERP data sources. He has significant knowledge working with different local ERP packages as well as global ERP solutions to identify, extract, map, modelling, analysis and visualizing data from different angles, transform such information into meaningful business interpretations.
Dakai combines his extensive knowledge of data analytics with his system development skills to assist clients from various industries. Including provide information system solution to meet client’s specific requirements on fraud/loss prevention and detection related issues.
Dakai also specialized in E-Discovery by assisting clients and their internal and external counsels to collect, preserve and analyze large volume of structural and un-structural data. He provides technical inside and identifies factual findings in related to various commercial investigations and litigations. Over the past years, Dakai has been leading numerous large E-Discovery projects in China for pharmaceutical companies.
In the past few years, Dakai helped clients investigate urgent cyber breaches such as ransomeware, phishing attacks, etc. by providing Incident Response service in Mainland China.

Mr. Eric Ho has extensive experience in Technology related roles across APAC and Europe. Eric joined Budweiser in Belgium in 2012 as project manager, delivering Supply Chain related initiatives such as APO, WMS, TMS. In 2016 he relocated to APAC to drive supply chain digital transformation. Since 2019, Eric has been leading Technology Operations & Cybersecurity for Budweiser APAC, covering domains from Cybersecurity, Tech Compliance, Infrastructure Architecture and Operations, DevOps Engineering, and Digital Workplace Services. He led the expansion of APAC Cybersecurity team from 0 to 1, in which the team now cover domains such as Application, Supply Chain, Data, Network, and Cloud Security. Eric continues to focus on implementing sustainable cybersecurity practices during organization’s digital transformation, prioritizing the right resources and projects that matters most.

Ms. Beijue Tang is currently the Director of Legal&Tax APAC of Wuerth China Holding, which is a shared service center with its legal services accessible for Wuerth entties in the Asia-Pacific area. Beijue majored in law studies in East China Universitry of Political Science and Law and obtained LLM from Fudan University. Before joining the Wuerth Group, she worked in AllBright Law Office and Weir China as legal counsel. Her professional area covers several topics from compliance, contract mangement, insurance to intellectual property rights (IPR) and further general corporate affairs. Beijue became a Vice-Chair of the Legal & Competition working group of the European Chamber in 2022.

Mr. Michael Tan
Michael has more than 20 years of experience in advising international companies on their operations in and with China. He has profound experience advising industrial clients in various sectors, covering all legal aspects of a typical investment deal like market entry and joint ventures, M&A restructuring and exit. Throughout his two decades’ practice, Michael has been gradually converging his energy on technology driven business and has built up his reputation and connections in the circle.
As the first Chinese partner of Taylor Wessing, Michael is now heading the firm's TMC practice for China. Besides his expertise regarding general corporate and commercial matters, he specializes in IT regulatory and data/privacy protection areas. Michael holds CIPP/E certification as granted by the International Association of Privacy Professionals (IAPP). At the same time, he frequently publishes articles and comments on IT and technology related legal topics.
Michael is National Vice Chair of the Legal & Competition Working Group under the European Chamber of Commerce. He also serves as an arbitrator of the Shanghai International Arbitration Center.
Michael studied law at the University of International Business and Economics in Beijing (UIBE), China, where he also completed his LLB and LLM degrees in 1997 and 2000 respectively. In 2006, Michael received his law doctorate from UIBE. In 1997, Michael was admitted to the Chinese bar. After practicing in domestic law firms, he worked in the Beijing office of a major international law firm from 2000 to 2002. In 2002, he joined Taylor Wessing in the Shanghai office. As of 2007, he has been appointed as a partner of Taylor Wessing.

Mr. Michael Shen joined IS team at IKEA China in 2020. He drives and promotes the identification, development and implementation of data privacy mechanisms, processes, and practices across the organization.
With his deep understanding of laws and regulations in areas related to data security and personal information protection, Michael participated in the development of strategic build-up at IKEA China for data security and privacy compliance and was responsible for managing projects in the related areas. He evaluates and improves existing data protection frameworks and works closely with business functions to ensure sustainable privacy compliance across all operations within the organization. Michael also has a strong passion for driving a culture where security and privacy are the responsibility of everyone.
